By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Description of the Service
Birdi provides tools that enable businesses to manage communication with their customers, including:
- Business phone numbers
- Text messaging (SMS/MMS)
- Calling features
- Message scheduling and follow-ups
- AI-powered message suggestions and automated replies (when enabled)
Birdi is intended for business communication purposes only.
2. Eligibility and Account Responsibility
You must be at least 18 years old to use the Service.
You are responsible for:
- Maintaining the security of your account
- All activity conducted through your account
- Ensuring your use of the Service complies with all applicable laws, regulations, and carrier rules
3. Messaging Consent and Compliance
You are solely responsible for obtaining proper consent from message recipients before sending messages or placing calls using Birdi.
By using the Service, you represent and warrant that:
- You have obtained all required permissions to contact recipients
- Your messaging practices comply with applicable laws and regulations
- Your use complies with mobile carrier policies and industry standards
- You will immediately honor opt-out requests
4. Opt-Out and Help (STOP / HELP)
Birdi supports standard carrier compliance mechanisms:
- Message recipients may opt out at any time by replying STOP
- Message recipients may request assistance by replying HELP
You may not attempt to override, disable, delay, or interfere with these mechanisms.
5. Prohibited Uses
You may not use the Service to:
- Send spam, unsolicited, or deceptive messages
- Send marketing messages without proper consent
- Engage in illegal, fraudulent, or abusive activity
- Harass, threaten, or mislead recipients
- Impersonate another individual or business
- Share, sell, or misuse phone numbers or message data
- Violate carrier policies or messaging regulations
- Attempt to bypass Service safeguards or restrictions
Birdi reserves the right to suspend or terminate accounts that violate these Terms.
6. Emergency and 911 Disclaimer
Birdi is not an emergency service.
You acknowledge and agree that:
- Birdi does not provide emergency calling or messaging
- Birdi does not support access to 911 or other emergency services
- The Service must not be used for emergency communications
If you experience an emergency, contact local emergency services using a traditional phone service.
7. AI Features and Automation
Birdi may provide AI-powered features, including message suggestions and automated replies.
You acknowledge and agree that:
- You remain responsible for all messages sent from your account
- AI-generated content may not always be accurate
- You should review and configure automation settings carefully
Birdi does not guarantee the accuracy or suitability of AI-generated content.
8. Phone Numbers and Messaging Services
Business phone numbers provided through the Service:
- Remain the property of Birdi or its service providers
- Are provided subject to availability and carrier rules
- May be reassigned if your account is terminated or inactive
Message delivery and calling availability may vary by carrier and region.
9. Subscriptions and Payments
Certain features of the Service require a paid subscription.
By purchasing a subscription, you agree that:
- Fees are billed in advance
- Subscriptions automatically renew unless canceled
- Payments are non-refundable except where required by law
- Billing is processed by third-party payment providers
10. Suspension and Termination
Birdi may suspend or terminate your access to the Service if you:
- Violate these Terms
- Violate carrier or messaging rules
- Engage in unlawful or abusive behavior
- Create risk for Birdi, carriers, or message recipients
You may stop using the Service at any time.
11. Data and Privacy
Your use of the Service is subject to Birdi’s Privacy Policy, which describes how we collect, use, and protect information.
By using the Service, you consent to the data practices described in the Privacy Policy.
12. Third-Party Services
The Service may rely on third-party providers for messaging, calling, payments, and infrastructure.
Birdi is not responsible for service interruptions or failures caused by third-party providers.
13. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
Birdi makes no warranties that:
- The Service will be uninterrupted or error-free
- Messages or calls will be delivered successfully
- AI-generated content will be accurate or reliable
14. Limitation of Liability
To the maximum extent permitted by law, Birdi shall not be liable for:
- Lost profits or business opportunities
- Missed or undelivered messages or calls
- Incorrect or incomplete AI-generated content
- Indirect, incidental, or consequential damages
15. Changes to the Terms
We may update these Terms from time to time. Updates will be posted with a revised “Last updated” date.
Your continued use of the Service constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the jurisdiction in which Birdi operates, without regard to conflict of law principles.
